Types of Cases Patricia Depew Handles:
Chapter 7 Bankruptcy
Chapter 7 is the most common form of Bankruptcy. We find that most consumers and businesses choose to file a chapter 7 because Chapter 7 allows for the discharge of the entire debt, rather than the repayment. Bankruptcy attorney Patricia DePew evaluates your situation and helps you determine the right course of action.
If there is no other alternative than filing for bankruptcy, our office will prepare your documents and file the chapter 7 bankruptcy petition. Our law firm also handles the schedules and all necessary pleadings. You will be required to be present at a "341a" meeting. At this meeting, the chapter 7 Trustee will ask you questions about your liabilities and assents. Although we cannot answer any of the questions on your behalf, we will appear with you in court and represent you.
We defend our clients against creditors and trustees who may want to sue you in order to have the debts declared "non-dischargable" or seek to have the Bankruptcy Court deny any discharge in the bankruptcy petition.
Chapter 13 Bankruptcy
Chapter 13 applies to individuals and businesses that are able to pay back their debt. Chapter 13 will allows a debtor to restructure their debt, making the repayment of the debt more manageable.
Our law firm will prepare and file the chapter 13 bankruptcy petition. As with chapter 7 filings, we handle all of the schedules and all required pleadings. Our law firm will also work with you to prepare a manageable re-payment plan.
You will be required to be present at a "341a" meeting. At this meeting, the chapter 13 trustee will ask you questions about all of you liabilities and assents and your ability to make your chapter 13 payment plan. Although we cannot answer any questions on your behalf, we will appear with you and represent you. We stand by your side!
Chapter 11 Bankruptcy Cases
Chapter 11 is typically used to reorganize a business, cases filed under chapter 11 of the United States Bankruptcy Code are frequently referred to as a "reorganization" bankruptcy.
An individual cannot file under chapter 11 or any other chapter if, during the preceding 180 days, a prior bankruptcy petition was dismissed due to the debtor's willful failure to appear before the court or comply with orders of the court, or was voluntarily dismissed after creditors sought relief from the bankruptcy court to recover property upon which they hold liens.
We prepare all of your documents and file the chapter 11 bankruptcy petition. Our law firm handles all of the schedules and all of the required pleadings. Our law firm will prepare and file the required chapter 11 Disclosure Statement and the chapter 11 plan. We will stand by your side and represent you at the "341a" meeting and all other meetings with the U.S Trustee.
Our law firm will represent you at all of the debtor Bankruptcy Court hearings
